Information Collection and Use
The Courtland Consulting website and client portal uses forms in which you give us contact information (including your name, address, telephone number, and email address) so you can place orders, request information and support, make product suggestions and send us general feedback. For certain services, we may also request a credit card number, social security number or tax identification number, or other financial or identifying information.
Courtland Consulting receives and stores any information you enter on our Website or give us in any other way in our customer relationship management system, including through email, telephone, or other communications with our project management, customer service or sales departments. If you contact us for support, we will keep an internal record of the support given.
Courtland Consulting uses your information to contact you regarding functionality changes to our products and services, our Website, new Courtland Consulting services, industry trends, helpful tips, and special offers we think you’ll find valuable. If you would rather not receive this information, please see the “Updating Your Information” section below on how to change your preferences.
Courtland Consulting uses information gathered about you from our site statistics (for example your IP address) to help diagnose problems with our server, and to administer our Website. We also gather broad demographic information from this data to help us improve our site and make your browsing and purchasing experience more enjoyable. This is not linked to any personally identifiable information, except as necessary to prevent fraud or abuse on our system.
Customer Request of Own Information
Upon request we provide site visitors with access to all information [including proprietary information] that we maintain about them, financial information (e.g., credit card account information) that we maintain about them, unique identifier information (e.g., customer number or password) that we maintain about them, transaction information (e.g., dates on which customers made purchases, amounts and types of purchases) that we maintain about them, communications that the consumer/visitor has directed to our site (e.g., e-mails, customer inquiries), contact information (e.g., name, address, phone number) that we maintain about them, and a description of information that we maintain about them. Customers can access this information by logging into Courtland Consulting Online Client Portal account or emailing us at email@example.com.
Upon request we offer visitors the ability to have inaccuracies corrected in contact information, financial information, and communications that the consumer/visitor has directed to the site. Customers can have this information corrected by logging into Courtland Consulting Online Client Portal account or emailing us at firstname.lastname@example.org.
For Courtland Consulting Store Customers Only
When you purchase goods through Courtland Consulting Store, you are granting Courtland Consulting express permission to share your name and contact information (as well as billing and shipping name and contact information, if different) with the merchant from which you make the purchase, for the purposes of shipping and order fulfillment only. By making a purchase from a merchant, you are not granting that merchant consent to use your information for marketing or any other purposes unless you specifically opt in to do so. Courtland Consulting has agreements with the merchants on the Courtland Consulting Store requiring them to maintain the privacy of your information; however, Courtland Consulting is not responsible for improper use by merchants of your information.
When you purchase a storefront or website to offer goods for sale through the Courtland Consulting Store, you will be prompted to enter information about your business, including business name, e-mail address and telephone number (all mandatory), and address, fax number and business hours (all optional). The business information that you enter will be publicly displayed on your storefront page, and will be included in confirmation e-mails sent to people who make purchases from you.
This site has security measures in place to protect against the loss, misuse or alteration of the information under our control.
Updating Your Information
You may alter your account information or opt out of receiving communications from us and our partners at any time. Courtland Consulting uses email to communicate with you, to confirm your placed orders, and to send information that you have requested. We also provide email links to allow you to contact us directly. We strive to promptly reply to your messages. The information you send to us may be stored and used to improve this site and our products, or it may be reviewed and discarded. Payment notifications for domain name, web hosting, SSL certificate or subscription, general announcements, etc. are sent to the primary account holder listed in the Courtland Consulting Online Client Portal.
Compliance with Laws and Law Enforcement
Courtland Consulting cooperates with US government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to US government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including without limitation subpoenas), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical. We will also share your information to the extent necessary to comply with ICANN’s rules, regulations and policies.
Third Party Service Providers
Courtland Consulting may at times provide information about you to third parties to provide various services on our behalf, such as processing credit card payments, serving advertisements, conducting contests or surveys, performing analyses of our products or customer demographics, shipping of goods or services, service needs, and customer relationship management. We will only share information about you that is necessary for the third party to provide the requested service. These companies are prohibited from retaining, sharing, storing or using your personally identifiable information for any secondary purposes.
In the event that we use third party advertising companies to serve ads on our behalf, these companies may employ cookies and action tags (also known as single pixel gift or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.
Supplementation of Information
In order to provide certain services to you, Courtland Consulting may on occasion supplement the personal information you submit to us with information from third party sources (e.g., information from our strategic partners, service providers, analytics, or the United States Postal Service, etc.). We do this to enhance our ability to serve you, to tailor our products and services to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you.
From time-to-time, Courtland Consulting may provide you with the opportunity to participate in contests or surveys. If you choose to participate, we may request certain personally identifiable information from you. Participation in these contests or surveys is completely voluntary and you therefore have a choice whether or not to disclose the requested information. The requested information typically includes contact information (such as name and address), and demographic information (such as zip code and age level note that you must be 18 or above to enter). We use this information to notify contest winners and award prizes, to monitor site traffic, and to personalize our site.
Courtland Consulting may use a third party service provider to conduct these surveys or contests. When we do, that company will be prohibited from using our users’ personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.
What Happens to my Personal Information if I Terminate my Courtland Consulting Account? When your Courtland Consulting account is cancelled (either voluntarily or involuntarily) all of your personally identifiable information is placed in a “deactivated” status or archived on our relevant Courtland Consulting databases. However, you should know that deactivation of your account does not mean your personally identifiable information has been deleted from our database entirely. We will retain and use your personally identifiable information if necessary in order to comply with our legal obligations, resolve disputes, or enforce our agreements.
Availability of Services
You shall be solely responsible for providing, updating, uploading and maintaining your server content and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your server, including, without limitation: trade or service marks, images, photographs, illustrations, graphics, audio files, video files, email or other messages, meta tags, domain names, software, and text.
You represent and warrant to Courtland Consulting that: your content does not and shall not contain any content, materials, data, work, trade or service mark, trade name, link, advertising or services that actually or potentially violate any applicable law or regulation or infringe or misappropriate any proprietary, intellectual property, contract or tort right of any person and that you own your server content and all proprietary or intellectual property rights therein, or have express written authorization from the owner to copy, use and display the content on and within your server account. If your web site includes images or photographs, you must ensure that your images or photographs are properly licensed. You also represent and warrant that the server content being hosted by Courtland Consulting shall not be used in connection with any illegal activity.
Abuse of Traffic or Storage
You are responsible for ensuring that there is no excessive overloading of Courtland Consulting® system or servers. In the event that you exceed your allotted bandwidth and thereby overload Courtland Consulting® DNS or servers, you shall be assessed any and all fees, costs and penalties associated with such overloading. You may not use Courtland Consulting®servers and your Server Account as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, denial of service, or other abusive activities. Server hacking or other perpetration of security breaches is prohibited and Courtland Consulting reserves the right to terminate websites that contain information about hacking or links to such information. Use of your server account as an anonymous gateway is prohibited, as is the use of your hosting service to restrict or inhibit any other user from using and enjoying the Internet.
Spamming or Unauthorized Access
Payment and Fees
Courtland Consulting reserves the right to suspend web services from viewing on the Internet when payments are five standard days past payment. Email payment reminders are sent to the primary account holder listed in the Courtland Consulting Online Client Portal. In case collection proves necessary, the Client agrees to pay all fees incurred by that process. For unforeseen server or network outages not caused by customer actions, Courtland Consulting offers a prorated money back guarantee for services. All payments are made in US funds.
We act in good faith to back up data stored on our shared servers once a day. These backups are intended for internal use only and Courtland cannot guarantee that a backup will be available for restore upon your request. It is your responsibility to back up data of all your content in order to prevent potential data loss.
We may determine that certain file extensions are not suitable for backup and exclude them from the backup. Such file types include, but are not limited to: iso; ace; arj; avi; bak; bin; bz; bz2; cab; car; cbr; ccd; cdr; cue; drw; exe; flv; gz; gzip; img; iso; jar; jmy; lbs; md; mid; midi; mov; mp2; mp3; mp4; mpa; mpeg; mpg; nrg; pae; pak; psb; psd; r00; r01; r02; r03; ram; rar; rm; rmf; sea; sub; tar; tar.gz; tgz; vob; wad; wav; wave; wma; wmv; zip. It is your obligation to verify whether particular files will be backed up.
Back Up Services are provided as is and are subject to all warranty disclaimers and limitations of liability set out herein. By purchasing services from us, including Back Up Services, you agree that you will maintain your own set of backups independent of those we maintain. If we provide data to you from a back up, it will be provided as raw data, and you may be required to reformat that data so that it reflects a prior configuration or use. Our only obligation is to restore your Space or Server to its operating condition. It is your obligation to restore your website.
In the event that any legal action is brought against Courtland Consulting, Courtland will require the client to compensate Courtland for all Legal Fees including but not limited to Attorney Fees, Legal Fees and any business time lost if Courtland is absolved of any wrong doing.
Copyrights and Trademarks
The client represents to Courtland Consulting and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Courtland for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Courtland and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
Courtland Consulting does not warrant that the functions contained in these web pages or the Internet website will operate uninterrupted or error-free. Courtland does agree to fix any errors, problems or non-functional areas within the bounds of their application development and hardware responsibilities. The entire risk as to the marketing performance and success of the web pages and website is with Client. In no event will Courtland be liable to the Client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if Courtland has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Courtland represents and warrants to Client that it has the experience and ability to perform the services required by this Agreement; that it will perform said services in a professional, competent and timely manner. Courtland also warrants that it has the power to enter into and perform this Agreement; and that its performance of this Agreement shall not infringe upon or violate the rights of any third party or violate any federal, state and municipal laws.
Content Management System (CMS) websites require upgrades that provide the latest version of the software program. Upgrades are necessary to keep in compliance with the changes in technology for the most current web coding standards, security protocols and versions of web browsers. It is optional but highly recommended that customers receive software upgrades on an ongoing basis at least once per year. The Courtland Consulting Team will keep your organization informed of security patches and software version upgrades and if there is an extra cost associated with the upgrade. Examples of reasons for upgrades may include: backend security updates; new features not available or found in previous versions such as updated administrative navigation, and module and design template enhancements or upgrades; and improved stability and increased performance. Courtland does not have any control over when security patches and software version upgrades are released nor do we have control of what will be included in any third-party software upgrades. Impacts to platform upgrades can include the following which can increase the number of hours needed to support the website: (1) A tool that the website uses is no longer supported. This would require Courtland to find a comparable and compatible tool to replace and potential data conversion from the old tool to the new tool. A tool is defined as a plugin, add-on, extension, etc. (2) The design template that the website uses may no longer be supported or compatible with the new software version. Having the template upgraded with the software upgrade is important to benefit from new features, best practices, security fixes or performance updates. This would require Courtland to apply a new or comparable design template to the website that works with the upgrade, and recoding and testing of the entire site and its functionality. (3) If a major architectural change is introduced at some point in the software’s version history, it will most likely require a lot of changes. This would require a migration path to convert the website for the upgrade and include recoding and testing of the entire site and its functionality. (4) A customization that the Courtland team implemented to an extension or to the core CMS needs to be re-implemented due to the upgrade or system patch. Depending on what or where this functionality is housed within the website, this might involve a simply fix or it might involve new custom coding due to changes in the extension, plugin or CMS. (5) Unforeseen technical issues can arise – the standard upgrade process can break, an upgrade server can go down, there is a version incompatibility somewhere within the website, etc. Various problems can arise during an upgrade that are outside of the major categories listed here, and when they do, the Courtland team will communicate with our clients and work through these issues.
